1.1. MapRecruit is a platform helping the customers reach out to jobseekers from the profiles that we received and conduct of the audio interviews while recording them. Apart from that MapRecruit also provide services like Resume Parsing, Visualizing those resumes, Scheduling Automated Interviews, Digital Marketing, Audio Interviews Analysis, Live/Offline Video Interview etc. which augments the recruiters capability.
1.2. By accepting the creation of a MapRecruit account, either created by you or on your behalf by a MapRecruit team member, or a member (or associate) of your own company you agree to abide by the terms of this Agreement. MapRecruit grants to you a non-exclusive, non-transferable license to use the Service(s) selected by you on the terms of this Agreement.
2.1. MapRecruit shall use commercially reasonable endeavours to provide 24/7 access to its online reporting through the MapRecruit. MapRecruit shall provide, at your cost and expense, all such reporting as you may reasonably request.
2.2. MapRecruit shall host, operate, administer, and maintain the Service in accordance with the terms of the Agreement.
2.3. MapRecruit shall provide such other professional services for integration, customisation, training, or other purposes as may be ordered in an Order accepted by MapRecruit.
3.1. Confidentiality. Each party will refrain from using the other’s Confidential Information except as contemplated by this Agreement and from disclosing such Confidential Information to any third party. The parties will, in a commercially reasonable manner, store and protect the other party’s Confidential Information from unauthorised access. However, each party may disclose Confidential information of another party: (1) pursuant to the order or requirement of a court, administrative agency, or other governmental body, provided that such party give reasonable notice to the other party to contest such order or requirement; or (2) on a confidential basis to legal and financial advisers and institutional investors under appropriate non-disclosure agreements.
3.2. Users are prohibited from violating or attempting to violate the security of MapRecruit.com Site, including, without limitation: Accessing data not intended for such user or logging into a server or account, which the user is not authorized to access, Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, Attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to any MapRecruit.com site, overloading, "flooding", "spamming", "mail bombing" or "crashing", Sending unsolicited Email, including promotions and/or advertising of products or services, or Forging any TCP/IP packet header or any part of the header information in any Email or newsgroup posting. Violations of system or network security may result in civil or criminal liability. Users shall not upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libellous, vulgar, obscene, or racially, ethnically, or otherwise objectionable. MapRecruit.com will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
3.3. You give permission for MapRecruit to access your account and analyse data or audio interviews for debugging or support purposes as is deemed necessary by MapRecruit.
3.4. You acknowledge that MapRecruit is required to retain Call Detail Records for such period as MapRecruit reasonably considers appropriate (subject to your right to request in writing that MapRecruit removes any Caller ID from such Call Detail Records in which case MapRecruit shall use reasonable commercial endeavours to remove such Caller ID from such Call Detail Records)
3.5. Each party shall take appropriate technical and organisational measures against unauthorised or unlawful processing of the Personal Data or its accidental loss, destruction or damage.
3.6. You acknowledge and agree to promptly provide to MapRecruit, without charge, such information and Personal Data as may be reasonably requested in order to comply with any law or request from any law enforcement or other regulatory agency, provided that doing so will not cause you to be in violation of any contractual or legal obligations.
4.1. MapRecruit Data comprises of Resumes, Parsed Info, User Information, Job Description information, Audio Recordings, Audio Analysis, User Feedback, Digital Marketing, and any data from external sources like social information, updated information, referrals etc.
4.2. MapRecruit will not share/sell your uploaded resumes/contacts as is with anybody and they are not for commercial purpose/benefit by any means.
4.3. While we do employ certain limited physical, managerial, and technical safeguards designed to help improve the integrity and security of our systems and the data stored on our systems, no physical or technical system, process, transmission, or storage mechanism is completely secure or immune from outages, losses, attacks, circumvention, design or implementation flaws, and human error. Therefore, we cannot and do not ensure or warrant that information you transmit to MapRecruit will not be lost or compromised, either during or after transmission. We take enough steps to secure the system with encryption, periodic backups of the data and restore the same if any unforeseen situation occurs.
If MapRecruit learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps.
MapRecruit is committed to protecting the integrity and privacy of personal information provided to MapRecruit’s digital talent interaction platform (the “Service”). This policy describes the types of information MapRecruit collects, and the ways in which MapRecruit uses and discloses that information.
5.1. MapRecruit as a Controller under the GDPR
Automatically Collected: When you use the Service, we may automatically record certain information from your web browser. This “automatically collected” information may include Internet Protocol address (“IP Address”) or other device address or ID, web browser and/or device type, the pages you view on the Service, and the dates and times that you visit, access, or use the Service.
5.2. MapRecruit as a Processor under the GDPR
User-Provided Personal Information: MapRecruit provides a platform enabling job candidates (“Candidates”), employees (“Employees”) and employers (“Employers”) to engage in a variety of interactive application, interview, and evaluation activities. The user’s mobile phone number and email address will be acquired in order to authenticate the login as well as to confirm the identity of the user and prevent any unauthorized use of the Service. In addition to this, candidates complete a MapRecruit Interview created by a potential employer which can include information such as work history, skills, experience, abilities, work style (all Resume attributes in HR-JSON) and other responses to questions, and submissions of a variety of types of media including audio and / or video interview and / or chatbot interactions.

Candidates have the right to know whether their Personal Data has been stored and can request us through Email to support@MapRecruit.com to verify the data, update, delete or erase permanently.
Users, at any time, want to delete or update their Personal Data, can request us through Email to support@MapRecruit.com. Users at any time can view their personal data that is available on MapRecruit by reviewing their user profile on the Product.
5.3. Cookies: When you use the Service, we may send one or more cookies. MapRecruit may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Service. Persistent cookies can be removed. Please review your web browser “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete, or choose not to accept, cookies from the Service, you may not be able to utilize the features of the Service to their fullest potential.
6.1. You shall not use the Services for any unlawful purpose whatsoever including the transmission or offering of any information or services which are unlawful, abusive, harmful, threatening, defamatory, or which in any way infringe copyright, intellectual property rights, trademarks, or which is pornographic, or any other material that may cause offence in any way.
6.2. You specifically agree to indemnify MapRecruit against all costs and liabilities arising out of all claims which result from, or involve an allegation of, any breach of clause.
6.3. You shall cooperate with MapRecruit in relation to any complaints, enquiries or investigations regarding services offered by you. You shall, at the discretion of MapRecruit, without limitation bear in full any costs associated with such complaints, investigations, or enquiries or any action whether or not brought by or against MapRecruit.
6.4. You are responsible for ensuring that no third party Intellectual Property Rights are infringed by your choice of telephone number for a particular service and indemnify MapRecruit against all costs and liabilities arising out of a breach or allegation of a breach of any such third party’s Intellectual Property Rights.
6.5. We are not calling without the customer’s consent. The calls are being initiated by the company with whom we think your consent already exists. We are not validating as it is not our responsibility and we are only a platform assisting the customers. You shall ensure that you have all necessary approvals, permissions or authorisations for the services operated through MapRecruit. You shall be responsible for the content of services offered, and for ensuring that these services comply with the Code, the Act and this Agreement.
6.6. TRAI Regulations - We strictly abide by TRAI rules and regulations and put our best effort to get aligned quickly if there are any changes to the regulations.
We do not SPAM and take utmost measure that it doesn’t happen. If anyone is concerned, we can quickly remove them from the list.
The Pricing is subjected to change as per the TRAI & Operator regulations from time to time. For any changes in the pricing, we will provide prior notification through Email.
MapRecruit may now or in the future be affiliated directly or indirectly with other companies, such as parent companies and subsidiaries (and their parent companies and subsidiaries), and reserves the right to transfer your Personally Identifiable Information to any of these affiliated companies. In the event that all or a portion of MapRecruit or its assets is acquired by or merged with a third party entity or is subject to a change of control all or a portion of the data and information in MapRecruit’s systems may be one of the assets involved in such transaction, and we reserve the right, in any of these circumstances, to transfer or assign all or a portion of the information that we have collected from users in connection with such merger, acquisition, sale, or other change of control.
8.1. Notices. All notices given by you to us must be given to MapRecruit via our Email address info@MapRecruit.com We may give notice to you at either the Email or postal address you provided to us when purchasing the Service. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an Email is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an Email, that such Email was sent to the specified Email address of the addressee.
8.2. Force Majeure. If the performance of any obligation hereunder is interrupted, delayed, fails and/or is interfered with by reason of any circumstances beyond a party’s reasonable control, including but not limited to acts of God, labour strikes and other labour disturbances, power surges or failures, disturbance to power supplies or the act or omission of any third party, non-performance by suppliers or subcontractors, inclement weather, storm, flood, drought, lightning, fire, shortage of power, disconnection damage or disturbance to telecommunications connections and cables, trade dispute, government action, embargoes, termination of or refusal to grant a licence, damage to or loss of equipment or interruption, failure or delay in any service provided to us by any third party including governmental or regulatory authority or telecommunications operator, war, military operations, or riot, the party shall be excused from such performance to the extent necessary, provided the party shall use reasonable efforts to remove such causes of non-performance.
8.3. Governing Law. This Agreement shall be governed by, and construed in accordance with, the internal laws of the State of Telangana / INDIA, without regard to the rules of the conflict of laws of such State.
8.4. Entire Agreement. The terms and conditions of this Agreement and the Order(s) supersede all previous agreements, proposals, or representations related to the Services. This Agreement sets forth the entire agreement and understanding between the parties pertaining to the subject matter hereof and supersedes all prior written or oral agreements between them.
8.5. Modification of Agreement. This Agreement may be amended, modified, or updated from time to time by MapRecruit.
8.6. Privacy. The parties to this agreement are independent contractors and nothing in this agreement shall be deemed to create a joint venture, partnership, or agency relationship between the parties in this Agreement.
8.7. Order of Precedence. In the event of any conflict between this Agreement and the terms and conditions of any Order, the order of precedence is as follows: (1) this Agreement, and (2) the Order.
8.8. No Waiver. The rights of each party hereto arising out of any provision of this Agreement or any breach thereof shall not be waived except in writing. Any waiver by a party to the Agreement of its rights under this Agreement or of any breach of this Agreement shall not be construed as a waiver of any other rights or remedies of any other or further breach.
8.9. Partial Invalidity. If any provision of this Agreement shall be declared invalid or unenforceable under applicable law, such invalidity or unenforceability shall not invalidate or render this Agreement unenforceable, but rather this Agreement shall be construed as if not containing the invalid or unenforceable provision. However, if such provision is an essential element of this Agreement, the parties shall promptly attempt to negotiate a substitute therefore that would preserve, to the fullest extent possible, the respective rights and obligations imposed on each party under this Agreement as originally executed.
8.10. No Third Party Beneficiaries. A person who is not a party to this agreement shall not have any rights under or in connection with it. The rights of the parties to terminate, rescind or agree any variation, waiver or settlement under this agreement is not subject to the consent of any person that is not a party to this agreement.
8.11. Errors. Any error, omission or typographical error in any website page, quotation, offer, sales information, invoice, or document supplied by MapRecruit shall be subject to correction from MapRecruit and without liability.
8.12. Modification. MapRecruit may vary any provision in this Agreement, without prior consent from you, if such change is required because of regulatory, insurance, safety or statutory changes made after the date of this Agreement.
8.13. You grant MapRecruit the right to refer to you as a “Client” and mention you and your brand, and company logos, in promotional material, both offline and online. You grant permission to do this during or after any MapRecruit services have been rendered activated or terminated.
